Children Team and Care Adoption

The Children Team can claim extensive experience and expertise in the full range of public law Children Act proceedings, acting for Local Authorities, parents and children in complex cases of alleged non-accidental injury, sexual abuse and cases involving foreign jurisdictions. In addition, members have extensive expertise in proceedings concerning children under the Adoption and Children Act 2002 and the inherent jurisdiction of the High Court.  The team has wide appellate experience in the High Court and Court of Appeal and is able to provide experts in the judicial review of local authority decisions concerning children and families.  Amongst the team’s recent reported cases are: 

M v Warwickshire County Council [2007] EWCA Civ 1084, [2008] 1 FLR 1093. Court of Appeal decision on the proper test for leave to apply to revoke a placement order under the Adoption and Children Act 2002.

Re R (Placement Order) [2007] EWHC 3031 (Fam), [2008] 1 FLR 1259. High Court decision on dispensing with parents’ consent to adoption and contact orders under s.26 of the Adoption and Children Act 1989.

Re T (Placement Order) [2008] EWCA Civ 248, [2008] 1 FLR 1721. Court of Appeal decision as to when the decision whether adoption was in a child’s best interests should be taken.

R (Hillingdon LBC and Others) v The Lord Chancellor [2008] EWHC (Admin) 2683.  Divisional Court decision on the application for judicial review of the Government’s decision to increase the issue fee for care proceedings.

Re B (Minor) 2008 EWHC1996. Decision on lawfulness of not resuscitating a disabled child.
