Children Team and Private Law

The Children Team has experience and expertise in all aspects of private law Children Act proceedings, including cases involving domestic abuse, residence and contact disputes, disputes as to the exercise of parental responsibility and international child abduction cases.  The team deals regularly with private law proceedings in which the child is separately represented under r.9.5 of the Family Proceedings Rules 1991. The team’s recently reported cases include:

Scotching v Birch [2008] EWHC 844 (Ch), [2008] All ER (D) 265.  Decision of the Chancery Division on whether siblings of a deceased child have the right to a say in the burial arrangements.

Re S and Others (Residence) [2008] EWCA Civ 653, [2008] 2 FLR 1377.  Decision of the Court of Appeal on the use of the welfare checklist and the role of the Children and Family Court Reported.
