Matrimonial Finance

The Matrimonial Finance Team has wide ranging expertise in all aspects of financial work following from divorce or separation including same sex relationships. Members of the Matrimonial Finance Team are experienced in claims under the Matrimonial Causes Act 1973, the Civil Partnership Act 2004, Schedule 1 of the Children Act 1989 and the Trusts of Land and Appointment of Trustees Act 1996. The team also deals with cases arising under the Inheritance (Provision for Family and Dependants) Act 1975.  The team’s recently reported cases include:

El Faragy v El Faragy and Others [2007] EWCA Civ 1149, [2007] 3 FCR 711, Times Law Reports November 23 2007.  Court of Appeal decision on bias and unfairness and whether a judge should recuse himself from ancillary relief proceedings.

Chambers provides expertise in the commercial and insolvency aspects of matrimonial finance.  Members of Chambers represented the Appellant in Hill v Haines EWHC 1012 (Ch) [2007] 2 FLR 983; [2007] EWCA Civ 1284 [2008] 1 FLR 1192 in both the High Court and the Court of Appeal.
